Nearly half of Canadian vape shops non-compliant with health and safety regulations, report says

Nearly half of Canadian shops selling vaping products were not in compliance following the latest federal enforcement efforts.

Earlier this month, Health Canada published a vaping compliance and enforcement report among retailers for April 2024 to March 2025.

The report said, during this inspection period, 43% of 546 specialty vaping businesses were found to be non-compliant with the Tobacco and Vaping Products Act and the Canada Consumer Product Safety Act.

That led to vaping products being seized by health inspectors at 235 specialty vaping establishments.

“The most common types of non-compliance were the promotion of prohibited flavours, testimonials or endorsements, packaging that did not meet the requirements for displaying a health warning, and packaging that indicates the nicotine concentration of the vaping substance exceeds 20 mg/ml,” the report said .

That is up from 38% from the previous year when 109 of 288 specialty vaping shops were found to be non-compliant.

Gas, convenience stores mostly compliant

However, the report found nearly all gas and convenience stores selling vaping products were compliant with health regulations.

On-site inspections at 2,354 stores was conducted by investigators. Of those, 2,136 were found selling vaping products and less than 1% — 12 stores — were not industry compliant.

“The most common types of non-compliance were the prohibited promotion of flavours and packaging that did not meet the requirements for displaying a nicotine concentration statement or health warning,” the report said.

The previous year, Health Canada said 3.2% of 1,609 gas and convenience stores that were inspected were not compliant with industry standards.

Manufacturers also inspected

Meanwhile, federal inspections at manufacturers of vaping-related products to ensure industry compliance during the same time frame was also conducted.

After 343 vaping product samples were collected for laboratory analysis from 119 manufacturers, health officials found 45% were non-compliant with key regulations. In addition, 2% were found to be non-compliant around child-resistant containers.

In addition, 44% of the 343 vaping product samples analyzed were deemed to be non-compliant with nicotine concentration requirements, and less than 1% were deemed non-compliant with vaping product labelling requirements.

Health Canada said investigators seized a total of 286,764 non-compliant vaping products from manufacturers.
